Cancellation Policy

At illuminIP, we aim to provide our clients with the best intellectual property services and solutions. We understand that circumstances may arise where a client may need to cancel a service. Our cancellation policy is designed to offer flexibility while ensuring fairness in handling cancellation requests.
1. General Cancellation Terms
Clients may cancel their services with illuminIP under the following conditions:
a) Cancellation Before Work Commences: If a client cancels a service before work has commenced, they are entitled to a full refund, minus any non-refundable third-party fees or government filing costs.
b) Cancellation After Work Has Begun: If a service is cancelled after work has commenced, the client will be charged for the portion of work already completed. Any remaining fees will be refunded, except for non-refundable third-party costs.

2. How to Cancel a Service
Clients wishing to cancel any services must follow these steps:
a) Submit a Written Cancellation Request: All cancellations must be requested in writing via email to info@illuminIP.com, specifying the service being cancelled, the reason for the cancellation, and any relevant information about the work already completed.
b) Acknowledgment of Cancellation: Upon receipt of the cancellation request, illuminIP will acknowledge the request within 5 business days and outline any applicable costs, remaining balances, or refunds.
c) Service Halt: Work on the service will cease as of the date the written cancellation request is received, unless the client specifies an alternative date in the request.

3. Non-Cancellable Services
The following services cannot be cancelled once they have commenced:
a) Government Filings: Any service that involves a government filing (e.g., trademark, patent, or copyright applications) cannot be cancelled after the filing has been submitted, as these processes are irreversible.
b) Third-Party Services: Services involving third-party providers, such as translators, technical experts, or consultants, cannot be cancelled once the third-party has begun their work.

4. Cancellation Fees
Depending on the service and the stage at which cancellation is requested, the following fees may apply:
a) Fixed-Fee Services: For services offered at a fixed fee, if cancellation occurs after the start of work, a prorated amount will be refunded based on the percentage of work completed.
b) Hourly-Billed Services: For services billed on an hourly basis, the client will be billed for any time spent on the service up until the date of cancellation, including time spent on any necessary administrative tasks related to the cancellation.
5. Impact on Ongoing Projects
For ongoing projects or retainer agreements:
a) Retainer Agreements: For clients on retainer, the cancellation will become effective at the end of the current billing cycle unless otherwise agreed upon.
b) Long-Term Projects: For large projects (e.g., patent prosecutions, IP portfolio management), any work completed prior to the cancellation will be invoiced, and the project will be halted without further action from illuminIP.

6. Refunds Related to Cancellation
Refunds, where applicable, will be processed in accordance with our Refund Policy. Any non-refundable expenses (such as government fees or third-party costs) will be deducted from the refund amount. Refunds will be processed within 14 business days of cancellation approval.

7. Exceptions to Cancellation
illuminIP reserves the right to decline cancellation requests under the following conditions:
a) Work Nearing Completion: If a service is in its final stages (e.g., a filing is being submitted or a legal matter is being concluded), the client may be responsible for the full payment of the service.
b) Late Cancellations: If a cancellation request is received after deadlines have passed for filings or submissions, the client will remain responsible for the associated costs.

8. Modifications and Amendments
illuminIP reserves the right to modify or amend this Cancellation Policy as needed. Any changes will be communicated to clients and updated on our website to ensure transparency and understanding.
